Birth Control Access

The Obama Administration made every reasonable effort to compromise with religiously-affiliated employers when implementing rules on women’s access to birth control coverage under the Affordable Care Act (ACA).

An update to the birth control benefit in the health care reform gives religious employers the ability to hand the responsibility to provide birth control coverage to a third party insurance company. But right-wing opponents led by the Conference of Catholic bishops are still balking at the plan.

President Obama did the right thing for women when he rejected the demands of rightwing activists and gave all women access to no-cost birth control through their insurance coverage. But before these new guidelines go into effect, his administration is holding a public comment period on the new rules. We know that anti-woman activists will flood President Obama’s Department of Health and Human Services with comments urging the administration to overturn its historic decision.

The Department of Health and Human Services and the medical community agree that providing no-cost birth control is an essential part of preventive health care for women. And Kathleen Sebelius, the director of HHS, said that providing birth control at no cost to women should be like “covering flu shots.”4

However, before activists from CREDO and Planned Parenthood began petitioning President Obama, the New York Times reported that the president was dangerously close to caving to the demands of the anti-woman lobby by adding a giant loophole that would keep a large number of women from being able to access no-cost birth control.5

CREDO members sent over 160,000 petitions and made over 3,000 calls to the White House asking President Obama not to cave. In the end, President Obama listened to our call to protect women’s health. But that doesn’t mean our work is done.

Some right-wing organizations are already balking at the plan even though it allows religious employers to avoid providing birth control directly to their employees. These anti-woman extremists will surely use the public comment process to file reams of objections to the plan. So let’s make sure the president hears from those of us who want him to stand strong and protect access to contraception.

Don’t Frack California

Dear Gabriel,

ban_fracking_CA_180California still has zero regulation to protect our health and water from dangerous fracking — but that’s not stopping the Bureau of Land Management from auctioning off almost 18,000 acres of land for oil drilling and fracking next week.

Fracking contaminates precious water with toxic chemicals, generates cancer-causing air emissions, and in California could pollute crucial agricultural water and lands in the Central Valley, as parts of Monterey, San Benito and Fresno counties are being auctioned off.

California’s environmental regulators are still drafting fracking regulations and fracking is exempt from many critical environmental laws like the Clean Water Act and the Safe Drinking Water Act, so the BLM’s rush to auction off federal mineral rights puts Californians totally at the mercy of the fracking industry and should not move forward.

Each fracked oil well permanently contaminates millions of gallons of water with toxic chemicals that can leak into nearby water sources and wells. That puts California’s farming communities, many of which sit on top of oil that would be extracted with fracking, at risk in cases of fracking spills, accidents or leaks. Worse, because many of the oil leases being sold by the BLM are underneath private land, farmers may not even have a right to say no to oil development on their land!

We know what the result of California’s rush to frack will be if we don’t stop it now. In states like Pennsylvania, Texas and Colorado, fracking is making landowners sick, killing livestock, poisoning water, devastating rural land values, and even possibly introducing toxic chemicals into our food supply, all while making us more reliant on planet-warming fossil fuels.

Many of these devastating effects are irreversible. That’s why it’s so important for the BLM to put its foot on the brake now, before selling off rights to oil companies to move ahead with totally unregulated fracking in California.

Let the Wind Blow

Dear Gabriel,

It couldn’t be clearer that we need more jobs and sources of energy that don’t bring doom and gloom to the planet.

Yet we are we are weeks away from losing one of the most successful programs to promote wind energy in the U.S., and tens of thousands of the jobs that have come with it.

The Wind Production Tax Credit (PTC), which expires at the end of the year, has been an unequivocal success since it was enacted in 1992. In addition to helping lower the cost of wind energy by 90% and power the equivalent of 12 million homes, the PTC supports 75,000 wind jobs and helps raise $20 billion in private investment in wind energy each year.

The PTC should be a no-brainer. But the Koch brothers-linked American Energy Alliance and Americans for Prosperity are waging a major campaign to sink it, and many Republicans are going along.

These Republicans are cynically claiming that we can’t afford the $1 billion-a-year program, even as the very same Republicans vote repeatedly to protect billions more per year in tax cuts and giveaways for the oil industry.

Their obstruction could cost an estimated 37,000 wind jobs over the next year, and already wind companies facing the changing economics without the PTC have laid off thousands of workers.

The PTC is a bipartisan policy originally authored by Republican Iowa Senator Chuck Grassley. Even the rabidly anti-climate U.S. Chamber of Commerce and National Association of Manufacturers support the program because it has been and continues to be a terrific investment. So any elected leader who votes against the PTC is doing so for one reason only: to protect polluters, even at the expense of American jobs.

The potential for wind energy in this country is massive — 20% of all our energy could come from wind by 2030, supporting half a million jobs. But the industry can’t grow without predictable policies. The PTC has been allowed to expire three times since 2000, and each time, new installed wind capacity, and jobs in the wind industry, have plummeted.

It should come as no surprise that it is extremely difficult for emerging sources of energy to compete, as the oil, gas and coal industries continue to benefit from nearly a century of government investment, subsidies, giveaways, tax breaks and now even a political system that has been shaped by their influence and money.

But for the sake of our future, clean sources of energy must not just compete, they must surpass fossil fuels. The PTC keeps us moving in the right direction and Congress should renew it right away.

California Paying For Death

For the first time ever, California voters have a chance to replace the deeply immoral death penalty by voting YES on Proposition 34.

The poll numbers are tight and they indicate that Californians are ready to end the death penalty with life in prison without the possibility of parole. But before they make the right decision to vote YES on 34, we need to give them the facts about how — beyond the loss of life — the death penalty imposes a very real financial burden on our state.

Spill Baby Spill – Arctic Oil

Dear Gabriel,

Weeks away from starting the first major offshore oil drilling operations in the Arctic, Shell is pulling a major bait and switch — telling the EPA it can’t meet the air pollution rules the company had already agreed to in order to get a drilling permit.

Shell has known since 2010 it would have problems meeting the rules for nitrogen oxide and ammonia emissions. But officials still told the EPA they could. Now Shell wants the EPA to weaken the rules at the last minute?

It’s clear that Shell simply cannot be trusted. The company’s request gives the EPA the option to cancel Shell’s permit. That’s exactly what EPA must do.

This is our last, best opportunity to block Shell from drilling in the Arctic this summer.

This bait and switch is the latest in a long list of broken promises, walk-backs and mishaps which should serve as clear signs to the Obama Administration that allowing Shell to drill in the Arctic is a recipe for disaster.

Just this weekend, Shell literally lost control of its Discoverer drilling rig, which either ran aground or very nearly did so, when its anchor broke while harbored a thousand miles south of the Arctic. Moderate winds are being blamed — yet these winds are mild compared to what it will encounter in the Arctic. The rig, one of the oldest in the world, had a similar anchor malfunction just last year, while it was stationed in New Zealand.

Shell is also having problems with its nearly forty-year-old oil spill recovery barge. While Shell promised the Coast Guard it would upgrade it substantially to withstand stronger weather, Shell now says those upgrades aren’t necessary. The Coast Guard hasn’t yet decided if it will weaken these standards for Shell.

And of course — while we’ve known for some time that the Obama Administration was being hoodwinked by Shell’s hopelessly inadequate oil spill response plan — now Shell has come out and admitted its initial spill response claims were overstated. Shell initially said it could “recover” 95% of oil in the case of a major spill. Now Shell is saying that what it actually meant is “encounter” 95% of the oil — whatever that means.5

Shockingly, the Department of Interior has put the probability of an oil spill in the Arctic at 40%.

That is simply unacceptable. With Shell in the driver’s seat, it’s clear that it would be unwise to even bank on those unacceptably high odds.

Shell’s request to EPA is a major opportunity for President Obama and the EPA to revisit the undeserved trust they have put in Shell thus far. It’s time for EPA Administrator Lisa Jackson to be a hero, and draw a line to stop the next major drilling disaster in the Arctic.

Overturn Citizens United

I have some exciting news for those of us who want to overturn the horrible Citizens United vs. FEC Supreme Court decision, which opened the floodgates for unlimited amounts of corporate money to flow into our political system.

The California state Assembly just voted to pass AJR 22, a resolution calling on the U.S. Congress to pass a constitutional amendment to overturn Citizens United and send it to the states for ratification.

AJR 22 now goes to the state Senate. If it passes there, California will be among the first states to officially call on Congress to amend the Constitution to undo Citizens United.

We deserve a government of, for and by the people — not one where our elected officials are bought and paid for by big corporations.

Sadly, we might need to work really hard to get unlimited corporate money out of politics and re-establish the common sense and democratic view that only people are people, not corporations.

But with 85% of the public opposed to the Citizens United decision, there is a potential for a broad coalition of Democrats, Republicans and Independents who all want to restore our democracy.

We can’t allow there to be inaction on this issue. It’s no exaggeration to say that the Citizens United decision fundamentally threatens the integrity of our democracy.

Even before the Citizens United decision, we too often saw the interests of Main Street subverted in favor of the interests of Wall Street.

But with the Citizens United decision now the law of the land, large corporations have the power to spend unlimited amounts of money from their general treasuries to buy elections.

What’s more, Citizen United opened loopholes that allow corporations to hide their campaign expenditures by laundering the money through non-profit advocacy organizations.

And because Congress cannot pass a law that supersedes a Supreme Court ruling, it may take a constitutional amendment to undo the worst aspects of the Citizens United decision and end corporate personhood.

Talk With Iran – No Killing

As we approach the ninth anniversary of the invasion of Iraq, we once again see dangerous momentum for another irresponsible, unnecessary and costly war — this time with Iran.

But as a result of the Iranian Revolution over 30 years ago, current law makes it very difficult for American diplomats to talk directly to representatives of the Iranian government.

That is why Congresswoman Barbara Lee has introduced legislation that, in her words, “directs the President to appoint a Special Envoy for Iran to ensure that all diplomatic avenues are pursued to avoid a war with Iran and to prevent Iran from acquiring a nuclear weapon.”1

Social Security is one of the greatest anti-poverty programs in our country’s history and is wildly popular. In addition, despite fear-mongering to the contrary, Social Security is currently running a surplus, will be fully solvent for decades, and is prohibited by law from adding to the deficit.

It’s a sad comment on our political system that an organization that represents older Americans needs to be pushed to stand up for Social Security.

But it’s better to speak out now and ensure AARP stands strong, than try to pick up the pieces after they cave.

Save Bryce Canyon

Save Bryce Canyon from Dirty Coal

The Bureau of Land Management (BLM) is on the verge of approving a massive 3,500 acre coal mine right next to Bryce Canyon National Park.1

The BLM’s own analysis shows that the mine will cause major adverse environmental impacts like increased water and air pollution,2 devastating a huge area directly next to Bryce Canyon’s unique ecosystem.

Despite these concerns the BLM just released its environmental review proposing that the mine be approved. BLM is currently accepting public comments on its proposal and strong public opposition is needed to convince the BLM to reverse course and reject this dirty coal mine.

The Bureau of Land Management’s review identified more than a dozen negative impacts this proposed mine is likely to have. These include water quality degradation, increased hazardous air pollution, loss of wildlife habitat, increased coal truck traffic and noise levels, adverse effects to recreation resources and an increased risk of fuel leakage, solid waste spills and wildfires.

In addition to the problems the BLM identified, burning coal from the proposed mine would also be a major source of greenhouse gas emissions, which experts say are now growing faster than previously anticipated worst case scenarios.3

Given all of the problems this mine is expected to cause, it simply isn’t in our best interests. Yet the Bureau of Land Management’s proposed action is to allow this dirty, 3,500-acre coal mine to move forward.

National Parks and federal lands belong to all of us, and BLM needs to hear from people who don’t want these special recreation areas and wildlife habitats — especially not Bryce Canyon — to be endangered in order to mine for dirty coal.

In the wake of huge story in the New York Times,1 three Senators and twenty Representative sent letters to President Obama, raising serious concerns about the major conflict of interest presented by the State Department’s selection of Cardno Entrix — a company with major business ties to TransCanada — to draft the environmental impact report and run local Keystone XL hearings.

Adding to the improprieties surrounding this pipeline, we also now know that the Koch brothers, despite previous denials, have a “substantial” financial interest in the construction of Keystone XL.

President Obama should be making a decision about our national interest — not the interest of TransCanada, Cardno Entrix and the Koch brothers.

The corruption and conflict of interest that we’ve seen in the State Department’s handling of the review process, are exactly the type of insider, closed-door cronyism and corruption that President Obama said we could all change.

That’s why so many of us spent so much time and money to work for his campaign in 2008.

It’s no secret that the Bay Area and Northern California were a huge sources of grassroots donations and energy for the campaign — with huge numbers of phone calls to swing states, huge numbers of people traveling to Nevada, Colorado — even Florida! — to get out the vote. And a whole lot of money.
